Terms of Service

Plain version: use Cue to ask people you actually know for things they'd reasonably expect. Don't use it to bother strangers. We'll do our best to keep it running, but it's a free service and we can't promise perfection.

1. Agreement

By using the Cue app or this website ("Cue") you agree to these terms. If you don't agree, don't use it.

2. Who can use Cue

You must be at least 13 years old. One account per telephone number. You are responsible for anything done through your account.

3. What Cue does

Cue sends a request you write to a person you nominate, records whether they agree, and sends a limited number of follow-up reminders. Messages are sent from Cue's own number, not yours.

4. Your responsibilities

This is the part that matters.

Breaking these is grounds for us closing your account without notice.

5. Content

You keep ownership of what you write and attach. You grant us only the permission needed to store it and deliver it to the person you sent it to.

You are responsible for what you send. We do not review content in advance, but we may remove it and suspend accounts when we're told about abuse. Report anything of that kind to support@endthenagging.com.

6. Message rates

Cue is free. Your mobile carrier may charge you for messages and data. That's between you and them.

7. Availability

Cue is provided "as is" and "as available". We do not warrant that it will be uninterrupted, timely, or error-free, and we do not guarantee that any particular message will be delivered — carriers, handsets and networks are outside our control.

Cue is a convenience, not a safety system. Do not rely on it for anything urgent, medical, financial, legal, or otherwise consequential.

8. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, or consequential loss, or for anything that happens because a message was late, undelivered, or misread. Where liability cannot be excluded, it is limited to CAD $50.

9. Ending it

You may delete your account at any time from Settings. Deletion is immediate and permanent. We may suspend or close an account that breaks these terms, or withdraw the service entirely, with notice where we reasonably can.

10. Changes

We may update these terms. If a change is material we'll update the date above and notify account holders in the app before it takes effect. Continuing to use Cue after that means you accept the change.

11. Apps from the App Store

Where you obtained Cue from Apple's App Store, Apple's standard Licensed Application End User License Agreement also applies, and Apple has no obligation to provide support or to address any claim relating to the app.

12. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, and the state and federal courts located in Delaware have exclusive jurisdiction.

Nothing here removes a consumer protection that cannot be waived under the law of the place you live. Where such a protection applies, it applies.
